SHIPPING METHOD: UPS- unless specified.

TAXES: Taxes, duties, tariffs shall be paid by the purchaser.

LIMITATIONS: Users are responsible for the suitabilty of our products to their applications. There is no warranty against damage resulting from corrosion, misapplication, excessive watt density, improper specification or other operating conditions beyond our control. In no event, shall Heaton co. be liable for
any direct or indirect, consequential damages arising from the sale of its products.

SHIPMENTS: Quoted ship dates are approximate. Heaton Co. will make every effort to maintain quoted ship dates. Heaton Co. will not be respondsible for conditions beyond our control causing delays in shipment or nonfulfillment of orders due to accidents, fire, flood, strikes, all acts of God, act of war, labour shortage, embargoes, regulations, orders and/or restrictions or any other causes beyond our control.

ACCEPTANCE: Purchase orders are acceptance as written, faxed, emailed or verbal. Verbal orders not confirmed in writting before manufacturing begins will be considered a firm commitment by purchaser. Upon acceptance by Heaton Co. orders are not subject to cancellation or modification, except upon written approval by authorized Heaton Co. personnel, and orders will be subjected to cancellation charges as determined by Heaton Co.

WARRANTY: Heaton Co. products are warranted against defects in workmanship and materials. This warranty consists of repairing and/or replacing free of charge if product is found defective within one year from purchase order date. No warranty is in effect on any product modified or altered by those other than factory authorized personnel. No product shall be returned without the approval of Heaton Co. . All product returns must be prepaid. All products require a Return Material Authorization (RMA) number. Products returned to factory without an RMA number will be returned freight collect. No other warranty, written or oral, expressed or implied, as to description, quality, Merchantability and warranties for a particular purpose apply. It is the user's sole responsibility for selection, suitability, misapplication, improper specifications, improper installation, contamination or other operating conditions beyond our control. Under no circumstances shall Heaton Co. be liable for loss of product or for damage of any kind whatsoever, including incidental or consequential damage.

FREIGHT DAMAGE: Claims must be filed immediately after discovering damage with the common carrier.
